2. Purpose and acceptance
These Terms of Use set out the rules for accessing and using the Site. By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
The Site provides general information about ABCThemis and its services, and free features such as the newsletter sign-up and discovery-call booking. A GDPR Quick-Scan is also available on request (see clause 5). Paid services are governed by the applicable Terms and Conditions (Legal Consulting Services or GDPR & Data Protection Services), not by these Terms of Use.
3. Access to the Site
We aim to keep the Site available, but we do not guarantee uninterrupted or error-free access. We may change, suspend or discontinue all or part of the Site at any time, without notice and without liability. You are responsible for your own equipment and internet connection needed to access the Site.
4. Acceptable use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in breach of these Terms of Use;
- attempt to gain unauthorised access to the Site, its servers or connected systems;
- introduce malware, or disrupt, overload or impair the Site;
- scrape, harvest or systematically extract content or data without our written consent;
- submit false information, or use the forms or the newsletter for spam or abuse.
5. Free content and tools — important notice
Information on the Site is provided for general information only. It is not legal advice, does not take account of your specific situation, and does not create a client relationship. No attorney–client privilege arises from using the Site. For advice on your situation, please seek a paid engagement or consult a licensed attorney where the stakes so require.
Free Quick-Scan (on request)
The Quick-Scan is a short self-assessment we make available on request: if you would like it, contact us and we will send it to you as a PDF by email. It gives an indicative overview only — it is not a compliance audit, not legal advice, and does not create any engagement or guarantee any result. Any decision you take on the basis of the Quick-Scan is your own responsibility.
Discovery call and newsletter: The free discovery call is offered subject to availability and creates no obligation on either side. The newsletter is optional and based on your consent; you can unsubscribe at any time. How we handle the personal data you provide is explained in our Privacy Policy.
6. Paid services
Where you engage ABCThemis for a paid service, that engagement is governed by the applicable Terms and Conditions and the accepted Quote. In the event of any conflict with these Terms of Use, the Terms and Conditions and the Quote prevail for that engagement.
7. Intellectual property
The Site and its content — including text, the "ABCThemis" name and logo, brand elements, layout, graphics and any downloadable resources — are protected by intellectual property rights and remain the property of ABCThemis (or its licensors). You may view and, where a resource is expressly offered for download, use it for your own information or internal business use.
You may not copy, reproduce, republish, distribute, sell or otherwise exploit any content of the Site without our prior written consent, except as permitted by mandatory law. The licensing of paid deliverables is governed separately by the applicable Terms and Conditions.
8. Links to other websites
The Site may contain links to third-party websites or tools. We provide these for convenience and do not control or endorse them; we are not responsible for their content, availability or privacy practices. Accessing them is at your own risk.
9. Personal data and cookies
We process personal data in accordance with our Privacy Policy, and we use cookies and similar techniques as described in our Cookie Policy. Both are accessible from every page of the Site.
10. Liability
The Site and its free content are provided "as is". We do not warrant that the content is complete, accurate or up to date, and we are not liable for any loss arising from reliance on the free content, or from the Site being unavailable or containing errors, to the fullest extent permitted by law.
Nothing in these Terms of Use limits or excludes liability that cannot be limited or excluded under applicable law. Liability in connection with paid services is governed by the applicable Terms and Conditions, not by this clause.
11. Changes to these Terms of Use
We may update these Terms of Use from time to time. The version in force is the one published on the Site when you use it; the version date is shown at the top.
12. Applicable law and competent court
These Terms of Use are governed by the laws of the Netherlands. Disputes relating to the use of the Site will be submitted to the competent court of the Rechtbank Midden-Nederland, without prejudice to any mandatory legal protection available to consumers.
13. Language
The Site and these Terms of Use are provided in English. Where we make a translation available (for example in Dutch or French), it is offered for your convenience and information only; in the event of any discrepancy or difference of interpretation, the English version of these Terms of Use prevails. This does not affect any mandatory right a consumer may have to receive information in their own language under applicable law.
